PATCHIE — TERMS OF USE

Welcome to Patchie. These Terms of Use (“Terms”) govern your access to and use of the website located at trypatchie.com (the “Site”), operated by Oakmont Media LLC dba Patchie (“Patchie,” “we,” “us,” or “our”). By accessing the Site, creating an account, or purchasing any Patchie products (the “Products”), you agree to be bound by these Terms.

If you do not agree to these Terms, please discontinue use of the Site.

1. Eligibility

You must be at least 18 years old to access or use the Site. By using the Site, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Medical Disclaimer & FDA Disclosure

Patchie Products, including wellness patches and supplement-related items, are not intended to diagnose, treat, cure, or prevent any disease. Statements made on the Site have not been evaluated by the Food and Drug Administration (FDA).

Our Products do not replace professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before using any supplement or wellness product, particularly if pregnant, nursing, taking medications, or managing medical conditions. Never disregard or delay seeking professional medical advice due to information found on the Site.

3. Account Creation & Security

You may create an account to access certain features. You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • Restricting access to your account

  • Ensuring that account information is accurate and up to date

You agree that Patchie is not responsible for losses resulting from unauthorized use of your account. If you believe your account has been compromised, notify us immediately at contact@trypatchie.com.

We reserve the right to suspend or terminate accounts at our discretion.

4. Product Information & Availability

We strive to provide accurate product descriptions, images, pricing, and availability information. However, we do not guarantee that all information is error-free, complete, or current.

Products may be modified, updated, or discontinued without notice. Patchie reserves the right to limit order quantities or refuse orders at our discretion.

5. Orders, Payments & Billing

By placing an order, you represent that:

  • The information provided is accurate and complete

  • You are authorized to use the payment method provided

  • You agree to pay all charges incurred

Payments are processed by secure third-party payment processors. Patchie does not store full payment card numbers.

We may refuse, cancel, or limit orders due to suspected fraud, unauthorized activity, errors, or other reasons permitted by law. If an order is canceled after payment has been captured, a refund will be issued to the original payment method.

6. Subscriptions & Auto-Renewals

If you enroll in a subscription plan, your subscription will automatically renew at the then-current rate until you cancel.

To avoid renewal charges, cancellations must be made at least 48 hours before your next billing date.

You may manage or cancel your subscription through your account or by contacting us.

Charges for already-processed subscription orders are non-refundable except as permitted under our Return Policy.

7. Promotions, Codes & Offers

Occasionally, Patchie may offer promotional codes, discounts, or special offers. These are subject to additional terms and may be modified or discontinued at any time.

We reserve the right to cancel promotions or reject orders where promotional abuse or fraud is suspected.

8. User Conduct

You agree not to engage in behavior that:

  • Violates any law or regulation

  • Infringes intellectual property or privacy rights

  • Attempts to access systems without authorization

  • Interferes with servers, networks, or Site operations

  • Sends harmful code, malware, bots, or scraping tools

  • Attempts to reverse engineer our software or systems

  • Harasses or abuses other users

We reserve the right to restrict or terminate access for violations.

9. Intellectual Property Rights

The Site, including all text, images, graphics, logos, product names, videos, and software, is owned by Patchie or its licensors and protected by U.S. and international intellectual property laws.

You may not copy, reproduce, modify, distribute, create derivative works, or commercially exploit any Site content without our written permission. 

10. User-Generated Content (Reviews, Comments & Submissions)

If you submit any content, such as product reviews, comments, photos, or suggestions (“User Content”), you grant Patchie a perpetual, worldwide, royalty-free, transferable license to use, reproduce, modify, publish, display, and distribute such content in any form.

You represent that:

  • You own or have permission to submit the content

  • It does not violate any laws or rights

  • It is not defamatory, obscene, or harmful

We may moderate or remove content at our discretion.

11. Electronic Communications

By using the Site or contacting us, you consent to receive electronic communications, including order confirmations, updates, and support responses.

You also consent to receive marketing emails and SMS/text messages if you opt in. You may unsubscribe or opt out at any time. 

12. Third-Party Services & Links

The Site may link to third-party websites or incorporate third-party services (e-commerce platforms, payment processors, analytics tools, etc.). Patchie does not control these entities and is not responsible for their practices.

Accessing third-party sites is at your own risk.

13. DMCA Copyright Policy

If you believe any content on the Site infringes your copyright, you may notify us with a written request that includes:

  • Your contact information

  • A description of the copyrighted work

  • Identification of the allegedly infringing material

  • A statement under penalty of perjury that your claim is accurate

  • Your physical or electronic signature

We may remove or disable access to infringing content as required by law. 

14. Disclaimer of Warranties

To the fullest extent permitted by law:

  • The Site and Products are provided “as is” and “as available”

  • Patchie disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement

  • We do not guarantee uninterrupted, error-free, or secure access to the Site

Product results vary from person to person.
 No specific health outcomes are guaranteed. 

15. Limitation of Liability

To the extent permitted by law, Patchie and its officers, employees, and agents are not liable for:

  • Indirect, incidental, special, punitive, or consequential damages

  • Loss of profits, revenue, or data

  • Damages arising from the use of or inability to use the Site or Products

Our total liability for any claim will not exceed the amount paid for the Product giving rise to the claim in the three (3) months preceding the event.

Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the maximum extent permitted.

16. Indemnification

You agree to indemnify, defend, and hold harmless Patchie and its affiliates from all claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of:

  • Your use of the Site or Products

  • Your violation of these Terms

  • Your violation of any rights of another person 

17. Arbitration Agreement & Class Action Waiver

By using the Site or Products, you agree that any dispute or claim arising out of these Terms or your use of the Site or Products will be resolved through binding arbitration, not in court, except for matters eligible for small claims court.

You further agree that:

  • There is no judge or jury in arbitration

  • Class actions, class arbitrations, and representative claims are not permitted

  • Disputes must be resolved individually

This section survives termination of the Terms.

18. Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Any legal action or proceeding (other than arbitration) must be brought exclusively in the state or federal courts located in New Castle County, Delaware. You consent to this jurisdiction and venue.

19. Force Majeure

Patchie is not liable for delays or failures caused by events outside our reasonable control, including natural disasters, labor disputes, supply chain disruptions, acts of war, pandemics, power outages, or system failures.

20. Assignment

You may not assign or transfer your rights under these Terms. Patchie may assign its rights without restriction.

21. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

22. Entire Agreement

These Terms, along with any policies referenced on the Site (such as our Privacy Policy and Return Policy), constitute the complete agreement between you and Patchie.

23. Changes to These Terms

We may update or modify these Terms at any time. Updates are effective when posted to the Site. Your continued use of the Site constitutes acceptance of the updated Terms.
